For those who are interested in the progress of #ConsumerDirectedBanking (#OpenBanking) in Canada, I encourage you to read our Senate Banking Committee’s report on our review of several specific sections of Bill C-69. We limited our observations to Part 4, Section 16 which outlines the first tranche of legislation designed to aid in the implementation of Open Banking in Canada. I encourage you to read these observations and share them with all who are interested in this important topic. This will be the first opportunity for Canadians to begin to control how their data is used …when/if the data mobility right included in Section 72 of Bill C-27 finally becomes law. Open Banking has been extensively studied and recommended, first by the Competition Bureau Canada in 2017, by the Senate in 2019 and through three intensive Finance Canada-led consultations in 2018, 2020 and 2022-23. #CompetitionMatters!

Yesterday, I appeared as a witness for the Senate Committee on Banking, Commerce, and Economy (BANC) where I made a case for strong penalties and hybrid offenses as part of Canada's new beneficial ownership registry. Bill C-69 features penalties of up to $100,000 for corporations that refuse to cooperate with law enforcement, or that knowingly falsely record information in the registry itself. The penalty scheme also features summary and indictable offenses for individuals from $200,000 to $1,000,000, or five years imprisonment for directors who are knowingly falsifying beneficial ownership information. These penalties are specifically targeted at criminals and transnational organized crime groups and won't apply to the vast majority of directors who are compliant, or who make simple administrative/filing errors. Enhanced penalties aim to make criminals think twice about laundering money through Canadian corporations by impacting their profit margins. #cdnpoli #endsnowwashing #banc See the full video with my remarks here:
