GCI: When GCI in Alaska shuts down cable TV service in 2025, will the company remain a cable operator under Title VI of the Communications Act? The answer could be an expensive one for Anchorage-based GCI, perhaps running in the many millions of dollars per year. "Any entity that no longer offers cable service also will give up the advantages or obligations of operating pursuant to Title VI of the Communications Act," said Cheryl Leanza, an attorney with Best Best & Krieger. Under current FCC regulations, something called the mixed-use rule bars cities from imposing their 5% cable franchise fee on the broadband revenue of cable operators. But the mixed use rule does not shield pure-play broadband ISPs, which looks like GCI’s future legal status in the coming months. The city of Portland has told the FCC that the mixed-use rule robs cities of $3.75 billion annually. GCI has 156,400 broadband subscribers. Assuming each pays about $70 a month for Internet, GCI could be on the hook for $6.6 million under a 5% right of way fee without the mixed-use rule backstop. That’s a big number compared to zero. It's always possible that GCI protected itself ahead of time in its latest franchise renewals and other legal agreements. "The impact of a decision to terminate cable offerings on the provider's continued operation, and on consumers, depends on state and local law and the agreements and permissions these providers have in place with the relevant authorities – including terms relating to terminating a franchise," Leanza said. https://lnkd.in/e2JPS_kj
