Truth or Dare? #Greenwashing continues to attract attention https://lnkd.in/gy75EWqM I am still a fan of companies that adopt a robust, credible, and reliable Environmental Management Systems (an #EMS based on the framework of #ISO14001). Let me stress though that credibility is in DESIGN, not whether you have a piece of paper that says you are certified. There are FOUR conformity assessment options in #ISO14001, what they offer CAN provide you with confidence that you have a system in place to better manage your relationship with the environment, taking into account the concerns of interested parties (which some refer to as stakeholders). It has always been important to be trusted in any relationship. But as #trust is devolving in so many situations, ensuring that you are not caught communicating some false, intentionally or inadvertently, is going to be a critical differentiator. Yesterday, the European Parliament approved the Corporate Sustainability Due Diligence Directive (CSDDD), bringing it closer to EU adoption! The #CSDDD, or #CS3D, introduces a legal liability framework for environmental and human rights violations in supply chains, emphasising sustainability and ethical practices. It sets a new standard for businesses operating in the EU, ensuring accountability not only for their direct actions but also for those of their subsidiaries and suppliers. Get ready for more sustainability and human rights compliance! Have you heard of the new EU Directive on Corporate Sustainability Due Diligence (CSDDD)? The EU is increasing the compliance requirements regarding corporate sustainability and human rights protection throughout global value chains. When it gets approved by the EU Parliament (expected to happen in April) and the member States, the new Directive on Corporate Sustainability Due Diligence (CSDDD) will require EU companies with over 1,000 employees and over EUR450m turnover in the EU to carry out a due diligence review of their supply chains and ensure and demonstrate that they adhere to environmental and human rights protection. The extraterritorial effect of this legislation may pose issues for global companies that will need to meet different requirements across multiple jurisdictions. 📢 #BizHumanRights & #Compliance ALERT: A COMPROMISE WAS FINALLY REACHED TODAY ON THE #CS3D #CSDDD (CORPORATE SUSTAINABILITY DUE DILIGENCE DIRECTIVE) BY THE #COREPER EU MEMBER STATES & THE Belgian Presidency of the Council of European Union ✍ After much upheaval, this directive is expected to be a game changer for businesses by ensuring that the products entering into the EU are made more sustainably and with greater respect for human rights and that businesses in the EU are acting more ethically in general. 🔎 Compliance-based approach: as with the French duty of care law and the #LkSG, companies should identify, prevent, mitigate, respond to, and remediate human rights abuses and environmental damage in their global value chains, throughout the entire upstream and downstream. 🌐 The minimum threshold is now set for European companies at 1,000 employees with a net worldwide turnover of 450 million EUR. 🌍 Companies already falling into the scope of the #CSRD are exempt from the obligation to adopt a #climate #transition plan 🌐 Scope of application - European companies: with 1,000 employees and worldwide net turnover exceeding 450 million EUR; - Non-EU companies (including the ultimate non-EU parent company): with EU net turnover exceeding 450 million EUR; - Companies which: (1) have entered into franchise or license agreements in the EU in exchange for royalties exceeding 22.5 million EUR in the EU; and (2) have net turnover exceeding 80 million EUR; and - Ultimate parent companies of groups of companies which, as a group, meet the minimum conditions for application of the directive. ⏲ Gradual entry into force of the directive - 3 years for companies with more than 5,000 employees and 1,500 million turnover; - in 4 years for companies with more than 3,000 employees and 900 million turnover; and - in 5 years for companies with more than 1,000 employees and 450 million turnover. ⚖ Consequences including civil liability for companies that cause or jointly cause harm by failing to carry out due diligence: - the text establishes a period of minimum five years to bring claims by those concerned by adverse impacts, including, under certain conditions, without prejudice to national rules of civil procedure; and - the compromise also includes elements on disclosure of evidence, injunctive measures, and a reference to the cost of the proceedings for claimants. ➡ The text needs now to go through the #EUParliament by the end of April 2024 Below is the text as of 13 March 2024.
