✅ #QuestionOfTheWeek: What can we do about an employee who is taking too many restroom breaks? When analyzing the impact of an employee's restroom breaks on productivity, focus on performance and coverage issues. If the breaks hinder productivity, address the situation with the employee. Consider legal obligations such as the Occupational Safety and Health Act, Pregnant Workers Fairness Act, and Americans with Disabilities Act. Provide accommodations if necessary based on individual circumstances and communicate expectations clearly, including consequences for non-compliance. Furthermore, be mindful of the laws that may apply, such as the requirements outlined by the Occupational Safety and Health Act, the extra bathroom break provisions under the Pregnant Workers Fairness Act, and the accommodations mandated by the Americans with Disabilities Act for employees with qualifying medical conditions. If the employee does not have a medical issue, clearly outline expectations based on company policies and ensure they understand the potential consequences for failing to meet those expectations in the future.
