HERE's the disconnect.....with Peter Malinauskas and our NEW Tenancy Laws According to our premier.....Landlords and agents can set terms and conditions in their tenancy agreements to require TENANTS to clean carpets at the end of the Tenancy. YET, according to CBS and their constant reminders that SUCH CLAUSES are ILLEGAL in South Australia, where to from here ????? We have just 6 days to figure this all out!!!!!!!!!!!!!!!!! CBS WESBITE: Lease agreement terms inconsistent with the Residential Tenancies Act 1995 (the Act) Under Section 115 of the Act": - a person who enters into an agreement or arrangement to defeat, evade or prevent the operation of the Act (directly or indirectly) is guilty of an offence. Maximum penalty: $50,000. Some examples of inconsistent terms are listed below: Carpet cleaning ‘All carpets shall be professionally cleaned by the tenant at the termination of the tenancy’.

If you remember, on March 28 we informed you on reasons permissable for a landlord to evict his/her tenants even if they pay rent. Today, we will be focusing on how the eviction of the tenant will be carried out. A landlord cannot forcefully eject a tenant without severe repercussions regardless of how difficult the tenant might be. The tenant rights must be respected. The legal way forward is issue a quit notice\notice to quit. The duration of the notice to quit to be issued to the tenant is dependent on the type of tenancy agreement between the landlord and the tenant; 1) For weekly tenancy, 1 week quit notice 2) Monthly tenancy gets a 1 month quit notice 3) quarterly tenancy will get 3 months notice 4) And for bi annual & yearly tenancy, a 6 months quit notice is to be issued After the expiration of the notice and the tenant hasn't vacated the premises, a 7 days notice to recover the premises is to be served on the tenant by you or your agent. A tenancy at will is a rental agreement in which either the landlord or the tenant may terminate the tenancy at any time, with reasonable notice. There is no fixed term or end date; the tenancy may continue indefinitely until one party decides to end it.
