I’m Continuing our series with Inc Magazine on the five things that will happen to you as a CEO: what are three ways to survive a lawsuit? It is a wonder that the longest-running shows on TV are always about courts, criminals, or lawyers. Whether we like it or not, we have a fascination with the legal world. I binged the @sorkinsays show @sho_billions Billions in two weeks. I never in my wildest dreams thought I would ever go to court or face a lawsuit. My idealism was that you wouldn’t need a lawyer if you didn’t break the law. Spoiler alert: I was wrong. At @helloalice_com , we were sued on the theory that grants that our clients provided to Black-owned businesses discriminated against White business owners. The trial court dismissed this case, but my spirit, mind, body, and budget are still dealing with it. As Ambrose Bierce once said, “Lawsuit: a machine which you go into as a pig and come out of as a sausage.” As a founder who was sued, I have personally been through the fiscal, managerial, and mental challenges that lawsuits cause. Here is my trinity approach to ensure you survive if you are sued: 1. Hire the best defense money can buy This might sound obvious, but hire the absolute best legal team that you can afford. We were lucky to have @nealkatyal You might want to go cheap. Your time still needs to be spent running the business. 2. Protect your employees The more you can keep this strain from your team, the more things will run as normal. After the news breaks, be clear with everyone about what is happening and the process that will be run, and then put it out of their line of sight. 3. Expect a large amount of personal stress Lawsuits are uniquely personal, even when about your business. They will push you emotionally in ways you have yet to experience.
