Disclose, disclose, disclose. If you’re a real estate professional, this should be one of your daily mantras. Sellers have a hard time revealing flaws about their home. But it’s in their own best interest to do so. In Texas, failure to disclose could result in recovery for a buyer's damages based on the omitted facts. This applies to ANY property. So let’s talk about a few scenarios. The buyer terminates the contract based on the inspection report and delivers the inspection report to the seller along with the termination. Does the seller have to share that report with future buyers? My answer is that the seller must disclose every flaw that is shown on the report, and the easiest way to fully disclose is to share that report with the buyer. “But what if the home inspector was an idiot?” Well, the problem is he’s a licensed idiot. The only way to combat a bad inspection report is to get another inspection report with an inspector you trust more. Then, disclose both reports. Even if the seller never received the inspection report from the buyer, if the buyer simply mentions a defect to the seller — then the seller must disclose it to another buyer. Now, what if your seller’s property is being sold for lot value only? Can you skip the seller’s disclosure notice (SDN)? If the value of the dwelling exceeds 5% of the total property value (determined by the Central Appraisal District), the answer is also yes — you still need an SDN. If you don’t provide one, the buyer may terminate for any reason. This is an automatic out for the buyer you could have otherwise avoided. And remember, Texas law says sellers always have a duty to disclose defects to the buyer. So be honest. Disclose. Hiding problems is never the right move.

Why Is a Buyer Broker Agreement important? I’ve been asked this question many times... My response has always been that it informs how the client and the agent will work together, for how long, what the agent will do for the client, and how the broker will get paid. It creates an understanding as to how the client and agent will be on the same page; the agreement protects both parties and makes the whole real estate process flow more effectively. The Buyer Broker Agreement is structured to ensure both parties’ best interests are addressed. It presents the client or consumer with a transparent understanding of the services the agent will provide. For example: property searches, market analysis, negotiating offers, handling paperwork, etc. On behalf of the agent, it demonstrates the agent's commitment to ethical standards, professionalism and helps ensure that the agent's actions are aligned with their obligations to the buyer and comply with legal requirements. Benefits to the client: Dedicated professional support. Saves the client time, money, and stress during the home buying process. Builds security and trust between the client and broker. Encourages the agent to work diligently on behalf of the client. Clarifies expectations and responsibilities for both parties. Reduces the likelihood of misunderstandings or disputes. The buyer broker agreement will also establish roles and responsibilities for both parties. So have you discussed all the fine details? This is the reason most for sale by owner deals fall apart. While everything is an agreement between the buyer and the seller.
