⚠️ Cause & Effect ⚠️ During a conversation this morning with a UK Government department thats responsible for work and pensions, I heard that the government is well aware of how disabled people are being treated in business if an applicant does, or does not, announce their disability when applying for a role. 1. Pre-Announcement - The stats show that people who announce their disability in a job application are not being hired, irrespective of any guaranteed interview scheme. The stats show a clear discriminatory opinion of disabled people in the workplace. 2. Post-Announcement - Employees are leaving roles soon after discovering the extent to which supportive processes are missing within businesses and how being #DisabilityConfident is no guarantee. The root cause cannot be proven, but the courts are angry and actively punishing those who fail to support disabled people in the workplace and during the application process. Businesses must be able to provide evidence that controls exist to ensure adherence to the #EqualityAct2010 and that inclusion exists throughout the entire organisation. But above all, it's the right thing to do and not what people expect to see in 2024. #DisabilityConfident #Leadership #EmploymentLaw #NOGO #EqualityWatch

Making reasonable adjustments: balancing cost, practicality, and legal compliance for employers - Under the Equality Act 2010, employers have a duty to make reasonable adjustments to avoid substantial disadvantages for disabled employees compared to non-disabled employees. This duty applies to various aspects, including provisions, criteria, practices (PCPs), physical features of premises, and the provision of auxiliary aids. The aim is to ensure that disabled individuals can participate fully in the workforce, and failure to comply can lead to claims of discrimination and unfair dismissal. https://lnkd.in/g4FJ_tsW

A Maryland federal court recently entered a consent decree under which a state-run psychiatric facility will pay $270,000 to four female recreation therapists who were underpaid compared to their less experienced male colleague performing the same work. This consent decree resolves a suit filed by the EEOC under the Equal Pay Act. It also guarantees that the female therapists’ pay will be adjusted going forward, and that their pensions will likewise be adjusted to account for the compensation they should have been receiving. https://lnkd.in/etB-r8tp
