Marie Harlan has turned out to be every bit of the "shiny penny" that Miriam McHenry promised when she sent over a group of candidates for an associate attorney position in 2017, with Marie's résumé at the top of the pile. There are two keys to recruitment at our firm. First, the attorney has to figure out that the Big Law platform doesn't work for them. We never want to be the reason anyone leaves Big Law; for what it's worth, Big Law does a good enough job of that on its own. Instead, we want to focus on why specialization in a single, narrow practice area is the right way to practice law. There is a great deal of allure in wanting to learn and do different things. But doing only one thing, and doing it well, helps landowners know we are the right firm for their specific problem. Marie was 100% on board from Day 1. Since joining the firm, she has immersed herself in the intricacies of eminent domain and condemnation law, and there is no one that I trust more on Texas regulatory takings and inverse condemnation issues. This will likely be the last time Marie is recognized as any kind of up-and-coming lawyer. From here on out, the recognitions will be for what she really is: an outstanding condemnation lawyer.

In this case, Duffy Kennedy (DK) argued that confidential statements made during a "without prejudice" meeting were used by the principal’s representative to take contractual action. However, the Court held that the privilege does not protect such disclosures in non-litigious contexts, reaffirming that information shared in settlement negotiations can still influence contractual decisions - whether or not a settlement is reached. This decision emphasizes the need for caution when discussing sensitive matters during settlement talks, particularly in construction disputes where the stakes are high and contractual outcomes are on the line.
