The Supreme Court of Puerto Rico has just published its decision in the landmark case, Colón v. Báez, addressing the ownership dispute over the MECA Art Fair trademark. This ruling not only marks a significant victory for my clients but also provides some much-needed guidance in regards to who owns the rights to a trademark once the company that owned it is dissolved. Key takeaways from this case: ✅ Always register your trademark! ✅ Simply having an idea or name isn’t enough. Trademark ownership arises from actual use in commerce or an intent-to-use application. So if your business is not actually up and running yet, don’t sleep on that intent to use application! ✅ Have all your agreements in writing! Specially if you have business partners. Yes, that includes your friends. ✅ Define your Intellectual Property Rights!
