One of the key ideas that convinced me to join True Price in 2015, is that Human Rights and environmental impacts are two sides of the same coin. Without protecting the environment, we cannot secure Human Rights. Judicial activism or incremental interpretation of established jurisprudence? Whichever one's views - and whatever the line that may be adopted by some in Switzerland and other Contracting States - the Court's ruling in KlimaSeniorinnen is here to stay. It is bound to shape not only the future landscape of climate litigation, but also (and profoundly) how we as citizens perceive the scope of our fundamental rights and the corresponding expectations from our governments. Exciting times ahead!
In an article published by the New Law Journal, David Lawne, Luke Grimes and Ginevra Bicciolo discuss the seminal judgment in the case of Verein KlimaSeniorinnen Schweiz et al v Switzerland. The European Court of Human Rights found for the first time that a country’s failure to combat climate change constitutes a violation of #human #rights under the European Convention on Human Rights. This is a really important development which the insurance and reinsurance sector should take notice of. #mannheimfoundation has been arguing for some time that failure by companies and organisations to take measures to fight the causes and impact of climate change constitutes a moral hazard, which should render them uninsurable. Non-availability of insurance and reinsurance would provoke an instantaneous response because businesses need insurance to operate. They would be compelled to implement measures to tackle climate change. Now that climate change inaction has been deemed to be a breach of human rights, it is no longer just a moral hazard and the insurance and reinsurance sectors need to reflect this in their policy wordings. #insurance #reinsurance #ESG #climatechange #sustainability

⚠️ The environmental emergency cannot be addressed if those raising the alarm and demanding action are criminalized for it. 4dThis is a disturbing trend, along with the increasingly draconian punishments, including up to 2 years Jail and fines of up to $20,000 in Australia. These are disproportionately heavy sentences designed to intimidate and stifle protest. NSW and Tasmania are the worst offenders. Alarmingly these recent laws have been passed with bipartisan support.
