Governor Maura Healey today signed into law the Housing Bond Bill. The Village of Croton-on-Hudson is considering "Good Cause Eviction" legislation. While the goal of protecting tenants is important, the reality is that this law could have far-reaching consequences that hurt housing affordability and discourage real estate investment. New York already has some of the strongest eviction protections in the country. This proposed "Good Cause Eviction" law would disincentivize housing providers from maintaining or upgrading properties, limit property rights, and potentially drive small housing providers to sell, reducing the availability of affordable housing. "In 1975, the state Supreme Court court ruled in favor of Ms. Lawrence and the other plaintiffs. It said that Mount Laurel had to change, but the decision went much further, interpreting the state’s constitution to require each of New Jersey’s 564 municipalities to build their fair share of affordable housing. Yesterday, planners in Minnesota got a huge WIN when the state legislature voted to protect comp plans advancing local housing reform from out-of-context environmental lawsuits. Passage of the Comp Plan Clarity bill also means that the City of Minneapolis can resume implementation of its 2040 Plan—a plan that has helped the city grow housing supply by 12% while rents grew by just 1%, according to @Pew. I’ve said it once—and I’ll say it again. Planning is THE best way to produce more diverse, attainable, and equitable housing options. Ultimately, this is about putting information--and power--in the hands of the tenants.
BREAKING: We've filed a lawsuit against the New York City Department of Housing Preservation and Development. In 2022, New York State passed a law requiring HPD to publish violations in public housing on their online database—which they already do for privately owned buildings. Instead of following the law, HPD keeps NYCHA residents in the dark, preventing them from accessing information that could impact critical housing decisions or their ability to challenge their landlord in court. The lack of transparency also keeps a veil over the reality of building violations throughout the five boroughs, which we know from our clients are heavily concentrated in NYCHA properties. You would never know it from HPD data because they still don't publish it, despite a law that says they must.
