I am posting to seek and share the knowledge of fellow members in this platform. Construction program: One EPC Contract was awarded to a contractor to construct three underpasses including approaches and service roads. Contract duration was 550 days. As an obligation, initially, the Contractor submitted a construction program where he planned to execute all the underpasses simultaneously. Further, planned to execute misc. items like road marking, sign boards, street lighting etc. in the project (in all the three underpasses), at the end for 3 months which is general practice. However, the Client had failed to handover the site in one of underpasses and it was handed over to the Contractor just before original completion period for which the Contractor was eligible for EOT of 6 months. However, certain misc. works were pending in other two underpasses But, there were no other hindrances in other two underpasses. The Contract says “EOT will be allowed to affected works only”. Now, if the delay is included in program, completion is getting extended by 9 months (6 months for underpass + 3 months for misc. works in all the three underpasses as per original program). Practically, as there were no hindrances in other two underpasses, they should have completed within time and extension can only be allowed for a period of 6 months for hindered underpass. This is also in line with the Contract. A question poses, how a construction program is binding to client? Is it for Contractor’s “internal “purpose only? Is it the obligation of contractor to execute the works as per its program submitted which mere a plan? Interestingly, in Balfour Beatty Construction Ltd v. The Mayor and Burgesses of the London Borough of Lambeth (2002), the court said “In determining an extension of time, the ‘foundation’ should be the original programme, subject to justification and substantiation of its validity and reliability.” Amit Kathpalia, MRICS, FIE, FICCP, Sr PE,
