This is my most recent law blog on the case of Curtis v. Bank of Nova Scotia. This is a defamation case in which the plaintiff, a former employee of the bank, was awarded $850,000 in total damages as a result of the bank's decision to post a statement, which was defamatory of the plaintiff, on the SIFT alert system. The court rejected the defences of justification and qualified privilege due to a lack of clear and convincing evidence. The District of Arizona recently dismissed a pro se litigant’s claims against a mortgage servicer for alleged violations of the FDCPA, reasoned the complaint had zero plausible basis in common and statutory law. This case should remind lenders that pro se plaintiffs often misread statutes and routinely misinterpret not only who or what can be defined as a “debt collector” or “debt collecting activity” under FDCPA, but also what is a viable claim under TILA. 📌📌Next Week on The Lobbying Agenda of Mortgage Brokers- Trigger Leads ✔️Mortgage brokers are pushing for action from congressional lawmakers regarding trigger leads, a controversial practice where credit reporting agencies sell consumers' information to third parties, including other lenders after they apply for a mortgage. This often happens without the consumer's knowledge or consent. ✔️Currently, consumers must proactively opt out and inform a credit reporting agency that their individual data should not be sold as a trigger lead. Legislation addressing trigger leads, known as the Homebuyers Privacy Protection Act, has been introduced in both the U.S. House of Representatives and the United States Senate during this legislative session. Advocates argue also that given the prevalence of #cybercrime and frequent data breaches, protecting borrowers' details should be even more of a top priority. 📢Can my house be sold without my knowledge? 📌 Once you become a homeowner and your name is written on the title, it may feel like your property is safe. Unfortunately, this does not protect you from property fraud. In fact, you are even more susceptible to it if: ✅ it is empty ✅ it is rented ✅ it is not registered ✅ it does not have any mortgage charges secured against it 📢 How do I protect my house from being sold? There are certain precautions you can take to protect your property from being sold without your knowledge. 1. The first step in how to protect property title is registering it with the Land Registry. If unregistered, you can apply for a first registration. This will give you proof of ownership and make it easier to manage the property. However, this is not enough to protect your house from being sold without your knowledge. 2. Additionally, you can set up a property alert land registry. This will let you know, free of charge, if any changes are made to the register in relation to your property. However, this does not stop them from taking effect, it will simply alert you of that matter. 3. When wondering 'how do I protect my house from being sold?' the best solution is to register an anti-fraud restriction on your property title. This ensures that should anyone try to fraudulently sell your house, no change will be registered unless a solicitor certifies that person is you. I recently obtained an injunction order that froze the accounts of a client’s ‘business partner.’ This individual had decided to drain my client’s corporate bank account and hold the funds hostage to coerce my client. Adding to the drama, the two individuals are brothers who no longer get along. It was a classic case of the elder brother taking the younger brother’s stuff because he didn’t listen to the elder brother. Unfortunately for the elder brother, his attempts to dominate his younger sibling backfired. The injunction hit him hard, leading to the cancellation of his mortgage and blacklisting by his bank. Although challenging to secure, a Mareva injunction can serve as a powerful weapon against such wrongful acts targeting your corporation. However, it also poses risks. Since the court conducts the hearing ex-parte, the applicant might face a substantial cost order if the court finds out that they obtained the injunction by misrepresenting facts. Thus, comprehending the Mareva injunction’s mechanism is crucial.
