Incident Date: 26th March 2024 Vessel: DALI IMO No. 9697428 Type: Fully Cellular Containership Incident: Allision with bridge – Refloated Further to our earlier reports in relation to the above captioned incident, we can now advise that DALI is scheduled to depart for Norfolk Va on/about 18th June to undergo repairs, and that sound/unaffected containers will be discharged in Norfolk before the repair process commences. Therefore, we again recommend that any cargo owners/insurers who have yet to provide/arrange GA/Salvage security proceed to do so as a matter of urgency. As advised, W.E. Cox have been appointed on behalf of a number of cargo interests and are perfectly positioned to survey damaged cargoes, assist in salvage sale and loss mitigation as well as provide General Average and Salvage Securities. I for one am unsurprised to learn of the application by the ship’s interests to limit liability based on the ship’s tonnage in this instance. USA is not a signatory to the 1976 LLMC convention - any limitation granted would be based on their own admiralty laws which go back to 1851. One of the main factors determining whether the application to limit liability shall be successful is whether the ship’s interests can establish that the DALI was seaworthy at the time of the commencement of the relevant voyage. (For example : Dirty fuel bunkers, arguably, would mean she was NOT seaworthy.) NB: Seaworthiness is generally understood to mean “fit for the voyage intended”
Incident Date: 26th March 2024 Vessel: DALI IMO No. 9697428 Type: Fully Cellular Containership Incident: Collision with bridge Further to our initial report in relation to the above captioned incident it has been reported that the Owners and Operators of the DALI, have filed a petition in the Federal Court of Maryland to limit their liability for claims arising from the allision with the Francis Scott Key Bridge to US$43.7m, being the estimated value of the DALI after Salvage and repair costs. Whilst operations to free the DALI have commenced it is not yet known when they will be completed and Owners have not advised if they will be declaring General Average. It is understood however, that damage to the DALI is significant and owners of sound cargo will continue to face significant delays in delivery. Richard Hogg Lindley (RHL) have been appointed as GA Adjusters and have advised that cargo will not be released to cargo owners until suitable Security has been provided by all cargo owners, both for General Average and Salvage. Whilst lightering operations have commenced Owners and Operators of the DALI have not yet provided an estimate of when or where sound cargoes may be available for collection or when and where damaged cargoes can be inspected.
