A week has passed since the Public Benefits Organizations Act No. 18 of 2013 (PBO Act) was implemented repealing the 34-year-old Non-Governmental Organizations Coordination Act, 1990 (NGOs Act). Many #NGOs had to endure the over a #decade-long wait to see the PBO Act come to life. Despite the decennial wait, many PBOs are not fully aware of what the PBO Act requires from them, the Authority and/or the Government. I have read the PBO Act and singled out the following paragraphs in the Transitional Provisions which I find rather intriguing: 1. If you were registered as an NGO in the NGOs Act. Your NGO is deemed duly registered under the PBO Act. However, you're required within one year to register with the Authority as a PBO. So what happens if your PBO fails to register within the one-year grace period? The Authority shall issue your PBO with a notice providing timelines for compliance. 30 days after the expiration of the timelines in the notice, your Organization shall lose its PBO status. 2. All #NGOs carry forward their pending obligations, and liabilities including the duty to submit annual reports or returns and their related penalties.  My thoughts: I also didn't think all the obligations, and liabilities would be pardoned by being swept under the new PBO Act carpet.  So make sure your PBO files annual returns and meets its obligations (past and current). 3. NOTICE: All NGOs exempted from registration in the NGOs Act have 3 months to apply for registration as a PBO.  The Public Benefits Organizations Authority (the Authority) is established under Section 34 of the PBO Act and shall take over the functions of the NGOs Coordination Board in addition to all other functions provided for under the PBO Act #NGOs #Compliance #Kenya
