I believe Donald Trump will seek to fire NLRB board members, Regional Directors, Administrative Law Judges, and dismantle the federal civil service immediately upon taking office. This effort will likely align with Elon Musk and the Project 2025 agenda, designed to provoke a legal challenge to the constitutionality of the National Labor Relations Act before the Supreme Court. Big corporations, union-busting law firms, right wing politicians, corporate funded think tanks, and billionaires will weaponize the Constitution as a facade to hide their true goal: the destruction of unions and the elimination of collective bargaining rights. Their strategy is clear—cripple the enforcement mechanisms of the National Labor Relations Board as the first step in a broader assault on the regulatory protections that Americans have depended on since the New Deal. This represents the beginning of a larger attack on our social safety net, targeting federal agencies like the Department of Labor, the Environmental Protection Agency, Social Security, Medicare, the Food Safety and Inspection Service, and the Consumer Financial Protection Bureau. Weakening these agencies endangers public health, financial fairness, worker protections, and environmental safeguards, threatening the very fabric of our society. The ultimate goal is to dismantle the protections that uphold our social contract and drive the nation toward authoritarianism and corporate dominance. The American people are at a pivotal moment. We can either allow billionaires and elites to hijack the American dream, or we can fight to preserve the values enshrined in our Constitution—due process, equal protection, and the right to opportunity. The fight is here, and it has already begun.

The Supreme Court's recent decision in Loper Bright Enterprises v. Raimondo has shaken up the way federal regulations are interpreted and enforced. This could have significant implications for workplaces in the long run. For the past 40 years, the "Chevron Doctrine" gave federal agencies leeway in interpreting ambiguous laws. Courts would defer to these interpretations as long as the agency acted within its authority. The Loper decision throws that out. Now, courts will take a more active role in interpreting federal laws, potentially leading to more legal challenges to agency regulations. Potential Workplace Impacts - Uncertainty: Businesses might face new interpretations of existing regulations, requiring adjustments in practices. - Increased Litigation: Agencies like the Department of Labor (DOL) and Equal Employment Opportunity Commission (EEOC) might see more lawsuits challenging their regulations. - Focus on Experts: While courts take on a bigger role, expertise in areas like healthcare might still be crucial for interpreting regulations. Cherry blossom petals aren’t the only things dropping all over DC this April. A flurry of final rules is leaping off the Federal Register press—with more to come. As April winds to a close, the Biden administration likely only has a couple of more weeks to shield regulations from the statutory “lookback period” under the Congressional Review Act. If rules are finalized after the lookback period, a new Republican government could quickly strike down key regulations. Standing room only for “the niche crowd” 👋😉 at this afternoon’s Institute for Government event with Shadow Leader of the House #LucyPowell. I came away with the clear message that Labour is thinking hard about how to take a practical grip of the work, culture and effectiveness of Parliament. Beyond just post-election planning, the party seems to be actively developing government-in-waiting mechanisms that will set expectations within the party and continue into government. Like Labour’s future legislation committee, which is scrutinising legislative plans for probable a busy King’s speech and beyond. What caught my ear? - New MP boot camp: whatever the result of the election, there’ll be an incredible number of new MPs. Grappling with practical arrangements will be par for the course. But there is also a recognition that more needs to be done to ensure new MPs thrive and not just survive. - Well-prepared legislation: an interesting focus on raising the standards of preparation to ensure legislation is ready to come to Parliament. That matters given the need to reduce both the delays and significant re-writing of legislation we’ve seen during this parliament (see DPDI mk2). Practically this seems to mean improving the work of the Parliamentary Business and Legislation Committee and how departments/ministers are held to task on legislation. - Pre-legislative scrutiny: lots of warm words in support of this, especially for complex and novel issues. Practically Labour will need to make clear that ‘draft’ isn’t shorthand for ‘go slow’. Will Parliament use experienced select committees more or experiment with different/radical forms of committee for draft bills (maybe even something like hybrid #citizenjuries?) - Regulators: an unsurprising question about how Parliament can better hold regulators to account. Positive noises around select committees doing more and requiring more from regulators. (But will see more from the Institute on this topic tomorrow!) But there was also a really important, non-wonky focus in Lucy’s speech on modernising and improving the representation, behaviours and culture around Parliament. #Labour
