El ECONOMISTA By:Gerardo Hernandez Monday, September 30, 2024 “ What happens if you work on October 1?: The legal scenario of rest days in Mexico According to the Federal Labor Law, people are not obliged to provide their services on a holiday, but for those who have work activities, the legislation also contemplates a special compensation.” TAKEAWAY: 👉 Now published in the Official Journal of the Federation (DOF), October 1, is a mandatory day of rest every six years for workers in Mexico, due to the transmission of the Federal Executive Branch. This was historically happening on December 1. 👉 Under this labor law reform Mx workers are not obligated to render their services on October 1 of every six years and they will receive there full salary. 👉 Those persons working on a mandatory rest day are entitled, in terms of the labor legislation, to receive payment of double their daily base salary in addition to its ordinary salary of the day worked. 👉 Now the Mexican Federal Labor Law contemplates 9 rest days, 7 fixed, 1 every 3 years and 1 every 6 years. 👉 Vacations days + official rest days of a worker first year of seniority in a company has about 20 days off, keeping Mexico as one of the OECD members with shortest rest periods. https://lnkd.in/ggzn--Uc

📣 Actualización sobre la jornada laboral en España El Gobierno ha anunciado que iniciará los trámites parlamentarios para reducir por ley la jornada laboral a 37,5 horas semanales, según informó el secretario de Estado de Trabajo, Joaquín Pérez Rey. Este cambio aún está en proceso y no cuenta con acuerdo con las organizaciones empresariales. 🔹 ¿Qué implica esta medida? La reducción de la jornada laboral supondría una disminución de 2,5 horas por semana. #ColombianNews | Maximum Weekly Work Hours to Decrease Again As of July 16, local businesses can only require that local employees work a maximum of 46 hours per week. Last year the weekly maximum was decreased to 47 from 48. ⏰ ¡Atención! ⏰ El pasado 17 de julio se hizo una nueva reunión donde se discutió la posibilidad de reducir la jornada laboral. 🕒 Las negociaciones sobre la reducción de la jornada laboral en España se han intensificado, con el gobierno mostrando flexibilidad para facilitar la transición de las empresas a una jornada de 37,5 horas semanales. También se trató la posibilidad de una incorporación paulatina de esta medida a lo largo del 2025, incluyendo opciones como días adicionales de vacaciones o permisos. Morena proposes to add three holidays for workers In the Deputy Chamber, there are three initiatives that aim to extend the holidays for workers. “ “Chamber of Deputies should analyze a proposal to increase the days off for workers in the private sector. The initiative presented this week seeks to incorporate into the Federal Labor Law (LFT) three new holiday dates for people employed in the Private Initiative. …. It proposes to add to the LFT the first Monday of May (in commemoration of the Battle of Puebla on May 5), and on November 1 and 2 for the festivities of the Day of the Dead. With this proposal, in the Lower House three initiatives are added that aim to extend the holidays for workers, which include December 12, Day of the Virgin of Guadalupe, and one more that seeks to recognize November 2 as mandatory rest. "It is important to note that, despite the reform of the Federal Labor Law, to article 78, in which Mexico doubled its number of 12-day vacations, continues to be placed in the last places of the OECD in paid annual leave and official holidays," says the deputy. Currently, Mexico recognizes nine days of mandatory rest for workers, of which two of them are only enjoyed when there are elections or by the transmission of the Federal Executive Branch. And the holidays? Mandatory rest dates are not counted as holidays for workers; that is, they are additional to the vacation period to which they are entitled according to their years of service. In the construction of the soccer stadiums, people worked with working hours of up to 20 hours a day for seven days a week. It may seem somewhat distant, but that labor exploitation is closer than we think. …….. “ Juan (a fictitious name to protect his identity) works a working day close to 69 hours per week, daily he works 12-hour shifts. Un aspecto que venimos alertando es en relación a la indemnización vacacional, ya que la Autoridad Fiscalizadora ha tomado una posición: se debe pagar en el mes que se genera la indemnización.

According to the Labor Monitor of El Economista, in the first session of the LXVI legislature, three proposals were presented to recognize new holidays in the Federal Labor Law. The proposals sought to add to the LFT on November 1 and 2 for the festivities of the Day of the Dead and on December 12, for the Day of the Virgin of Guadalupe. The projects argued, in addition to the importance of workers' rest for productivity, the economic impact of days off. In the case of December 12, a justification for the initiative is that it would not be the first time that labor legislation recognizes a religious date, this is the scenario of December 25 for Christmas. Although Mexico made an important advance with the decent vacation reform, which doubled the minimum vacation floor for workers, the country maintains a significant lag in rest days. If vacation days and official holidays are added, a worker in Mexico has about 20 days off in his first year of seniority in a company, a level that maintains our country as one of the economies with the shortest rest periods, according to the Organization for Economic Cooperation and Development (OECD).” https://lnkd.in/gnhZUgiT
