On April 10, 2024, the US Environmental Protection Agency (EPA) announced the final National Primary Drinking Water Regulation (the “Regulation”) for six per- and polyfluoroalkyl substances (“PFAS”) that may be present in drinking water. PFAS are known as “forever chemicals” due to their resistance to degradation in the environment when exposed to heat, cold, acidity, and traditional solvents—resulting in a long half-life. PFAS are pervasive. Products incorporating PFAS include nonstick cookware, waterproof textiles, medical devices, clothing, electronics and food packaging. Historically, PFAS were used in numerous manufacturing processes and products that are now subject to an ever-broadening array of state and federal regulation. PFAS should be tested in all products especially in food and beverage industries
The EPA will restart efforts to regulate fluorination coating of plastic containers, telling environmental and public health groups it accepted their petition to move ahead. This comes four months after a federal appeals court halted a widely watched EPA enforcement order against fluorination coating maker Inhance, saying EPA went beyond what chemical safety laws allowed. But EPA says it will take a different approach to regulating PFAS forever chemicals that can leak from the coated plastic containers. In a development that caught the attention of companies making non-fluorinated coating processes, EPA said it was specifically looking for information on alternative technology.

Minnesota Gov. Tim Walz has just signed the broadest ban on dangerous 'forever chemicals' into law, setting a new standard for environmental protection. This historic legislation, part of H.F. 2310, targets 13 product categories, including menstrual products, dental floss, cleaning supplies, and cooking equipment. Clear evidence of #DoubleMateriality: US EPA issues a complete ban of trichloroethylene — also known as TCE — a substance found in common consumer and manufacturing products including degreasing agents, furniture care and auto repair products.
