Being a #parent always imbues wisdom to being an #attorney and a #manager. The other day my oldest son, who is 5, asked why some playgrounds have woodchip surfaces and other playgrounds have rubber surfaces. Trying to answer this question reminded me of what I try to teach so many attorneys about answering the the "unasked question". As attorneys we get questions all day. Many of us fall into the trap of responding directly without taking a step back to ask why we are being asked the question and what the implications of an answer might be. What differentiates a great lawyer from a good lawyer is not whether the attorney knows a technical legal answer. The technical answer is the core competency of being an attorney. A great lawyer contextualizes the answer to the issues the question asker values most. When talking about the playground with my son we had to go into so many other questions to answer his question: - Do different surfaces feel better to the playground user? - Are different surfaces safer based on different equipment or usage? If so, what is the minimum level of safety we can accept? - How much do the surfaces cost to purchase and install? - How much do the surfaces cost to maintain? - Does one surface have a better aesthetic appearance than another? - Are there laws or regulations that may require different surfaces in different locations? When teaching other lawyers to answer questions, I always ask them to step back and ask what they would want to know if they were asking the question. How would you use the information given and what would you want to know if you knew which questions to ask? How do you teach others to answer the "unasked question"?
