Rent arrears and application of subsequent rent payments When your tenant is in arrears it is important that any rent that you receive is allocated appropriately and recorded correctly. Unless the tenant says the rent is for a specific rent period you apply the rent to the oldest arrears that you have. This has been defined in case law. It has been referred to in rent repayment order cases more than a 1000 times. Awad v Hooley First Tier Tribunal CHI/21UD/HMG/2020/0003 Upper Tribunal [2021] UKUT 55 is the case law that is relied upon. Seek professional advice if your tenants are threatening you with a rent repayment order. If you have received a letter from a company about a rent repayment order or from the First Tier Tribunal seek professional independent advice immediately as the first step.
