Tax and Trust expert Basil Dixon, Partner at Payne Hicks Beach, explores The Labour Government’s plans to reform the tax regime for non-domiciliaries and offshore trusts. Key changes include the replacement of the remittance basis with a new “FIG regime” for arrivers, the extension of the IHT tail to ten years for long-term residents leaving the UK and the abolition of IHT advantages offered by excluded property trusts. Under the new non Long-Term Resident (LTR) test, it's important to consider not only your position and scope of Inheritance Tax, but also that of your spouse or civil partner. For lifetime gifts, the spousal exemption will apply – meaning gifts are exempt from IHT. However, there are instances where these are not aligned and IHT might be due.
