Hon. Lady Justice Celia Nagawa recently observed that any child born during wedlock is presumed to be seed or product of that marriage but it does not apply to unmarried cohabitants. It is also applicable where conception took place during a marriage, even if death or divorce has ended that marriage by the time birth occurs. "DNA test is not required to prove paternity if there is a clear evidence of valid & subsisting marriage at the time of death of the spouse, unless proof has been adduced during the marriage that indeed the alleged child does not belong to the husband" To the layman, this ruling means that for a married couple, any child born or conceived during the marriage is legally presumed to be the husband's, even if the marriage ends in divorce or the husband dies before the child's birth. This presumption does not apply to unmarried couples living together. If there is a valid marriage, no DNA test is needed to establish paternity unless there is substantial evidence proving that the husband is not the biological father. The court also instructed the state to implement a digital registration system to prevent bureaucratic red tape in the future. 𝗗𝗼𝗲𝘀 𝗣𝗿𝗲𝗻𝘂𝗽𝘁𝗶𝗮𝗹 𝘄𝗼𝗿𝗸 𝗶𝗻 𝗜𝗻𝗵𝗲𝗿𝗶𝘁𝗮𝗻𝗰𝗲 𝗣𝗹𝗮𝗻𝗻𝗶𝗻𝗴? I chanced upon this article the other day about Janet Jackson (sister of Michael Jackson). It talked about the couple’s prenup that had a “business agreement” in it. Basically they have a deal whereby: If marriage lasts at least 5 years = $100M will be given to Janet If they have a son = another $100M will be given to her Long story short, they did have a son and then got divorced after exactly 5 yrs of marriage. Janet got $200M as per their agreement. It’s interesting because it is not the typical prenuptial that we hear of where the couple can protect their own assets before getting into a marriage—“what’s mine is mine, what’s yours is yours” In Singapore context, even the usual setup of a prenup is not widely practiced and it is not legally binding. We have this thing called the Women’s Charter Act that protects the equal rights of women when they go into a marriage. This is why prenup is not something that they would typically recommend because the Women's Charter will still be the overall governance. But if you ask me if prenuptial actually works in Inheritance Planning, I would say it can still be one of the common tools that your heirs can consider. But again, you have to seek professional advice because like I said, it is different here in SG and you have more things to consider. Different jurisdictions regard prenups differently so it’s best to be aware of these things before you come to a final decision. #Singapore #marriage
