Section 108(3) of the 1996 Act provides that a compliant construction contract shall provide “. . . that the decision of the adjudicator is binding until the dispute is finally determined by legal proceedings, by arbitration . . . or by agreement.” The same is provided for in paragraph 23 of the Scheme. What Sudlows says is, at the risk of oversimplifying: (1) Under the Construction Act, an adjudicator does not have jurisdiction to decide on a dispute which had already been decided in a prior adjudication. (2) “Whether one dispute is substantially the same as another dispute is a question of fact and degree”. It depends on what happened and what are being disputed. (3) “One must look at what the first adjudicator actually decided. Ultimately it is what the first adjudicator decided which determines how much or how little remains for consideration by the second adjudicator.” (4) Even if, for example, the issues in dispute in two adjudications “both concerned time and moreover the same time period”, they may not be substantially the same because a party may have argued it differently and used different evidence (such as an expert report generated after the first adjudication). (5) It is the decision of the adjudicator that is binding on the parties, not his/her reasoning. However, if the adjudicator’s reasoning or finding was an essential component of or the basis of his/her decision (for example, decision on prolongation costs arising from a finding on the extension of time a contractor is entitled to), that reasoning/finding may also be binding.

Let me share some thoughts as we start the week: I absolutely love driving down the Lekki Expressway, especially through VI, Lekki, and the Orchid axis. Whenever I do, I get thrilled by the sights. On either side, you see evidence of modernization and the level of civilization. But what excites me even more is knowing that Epe is on the cusp of experiencing the same transformation. Looking at VI, it's hard to believe that once upon a time, this land was bare, near void, and swampy . The same applies to Lekki. But the fact remains that VI gradually evolved to become what it is today, and Epe is well on its way to achieving the same. Consider this: the prominent establishments in Epe already surpass those in VI by a significant margin. Epe outweighs VI in terms of potential and growth prospects. Every time I'm there, I can't resist taking videos of the sights, imagining the future when Epe will mirror the progress of VI and Lekki. When you practice land banking, you're not just buying land for future use or returns; you're buying into a dream and taking a bet on the future. I love the whole idea of it. Picture this: "Son, I visited these lands before civilization came here. At the time, Alaro City was the biggest building on this axis, and these skyscrapers were nowhere to be found. That’s when I bought the hectares of land where Tosam Estate now stands. Here, let me pull up a video from the internet to show you."
