Today, on CNBC’s ‘Squawk Box. Joe Moglia discussed the NCAA’s pending settlement and its implications for collegiate athletics. The revenue-sharing model in collegiate sports heavily favors programs that generate significant income, primarily football and basketball. This model exacerbates the financial divide between these programs and smaller, less lucrative sports. The result? Dr. Sanjay Gupta and CNN have revealed that the Concussion Legacy Foundation worked with Riverdale Country School and the Metropolitan Independent Football League to eliminate the kickoff for member schools across New York, Connecticut, and New Jersey – and no one misses it! Dropping the kickoff, along with limiting hitting in practice to 15 minutes a week, helped reduce concussions by 33% - moreover, when parents heard about Riverdale's commitment to safety, football signups went up by 18%. We’re calling it S.M.A.R.T.E.R Football (Safer – Modified – Appropriate – Resilient – Trusted – Evidence-Based – Responsible) and any league can implement this model. Tennessee v. NCAA: NCAA Enjoined from Enforcing NIL Rules and Policies On February 23, 2024, United States District Judge Clifton L. Corker granted an injunction prohibiting the NCAA from enforcing name, image, and likeness ("NIL") rules and policies. Specifically, Judge Corker granted the Plaintiff's Motion for Preliminary Injunction and "restrained and enjoined [the NCAA] from enforcing the NCAA Interim NIL Policy, the NCAA Bylaws, or any other authority to the extent such authority prohibits student-athletes from negotiating compensation for NIL with any third-party entity, including but not limited to boosters or a collective of boosters, until a full and final decision on the merits in the instant action." Revenue Sharing Challenges One of the significant challenges posed by the NCAA's proposed governance changes is the issue of revenue sharing. If the House v. NCAA settlement is approved, Power Four schools may need to fund revenue sharing up to $22 million annually for the next decade. This financial burden could be particularly challenging for smaller schools within these conferences.
