Did you know that Gatorade® was invented during the 1965 Football Season? The drink was invented by Dr. Robert Cade and other scientists at the University of Florida (UF) to help keep athletes hydrated. The drink has gone on to be a commercial success that has helped keep countless athletes hydrated. Gatorade®, however, is a cautionary tale illustrating why companies should confirm that employees have signed their intellectual property agreements. UF initially passed on the drink and the Gatorade Trust eventually sold the product to Stokely Van-Camp. In 1971, UF sued the Gatorade Trust asserting ownership of Gatorade® after witnessing the drink’s commercial success. UF, however, made a strategic blunder they couldn’t blame the head coach for: an inventor never signed an invention agreement. The suit was settled in 1973 with UF receiving 20% share of the royalties.
