The Department of Commerce’s Bureau of Industry and Security (BIS) recently issued an Interim Final Rule further restricting exports to China of advanced-node semiconductors that can be used in the next generation of advanced weapon systems and in artificial intelligence (AI) and advanced computing. The rule places new controls on 24 types of semiconductor manufacturing equipment and three types of software tools for developing or producing chips. NLRB Bans Captive-Audience Meetings The National Labor Relations Board (NLRB) issued a major decision in Amazon.com Services LLC, banning the practice of “captive-audience meetings,” where employers mandate that employees attend meetings during which management expresses their views on unionization. This ruling overturns the landmark Babcock & Wilcox Co. decision, which had allowed employers to hold such meetings for more than 75 years. DOJ and FTC Withdraw Competitor Collaborations Guidance The Justice Department’s Antitrust Division and the Federal Trade Commission jointly announced on December 11 the withdrawal of the Antitrust Guidelines for Collaboration Among Competitors (“Collaboration Guidelines”), long-standing guidance on competitor collaborations. The agencies did not update the Collaboration Guidelines, but rather withdrew them with no replacement.
