Federal Court Judge blocks FTC’s implementation of its Rule banning Non-Competes. Judge Ada Brown of the Northern District of Texas in the Ryan LLC case held that the FTC lacks authority to create such a substantive rule. The Judge granted a preliminary injunction noting that the rule is likely arbitrary and capricious and unreasonably broad. The ruling is preliminary only until a final hearing is held, expected by August 30. #noncompete #FTC #federalcourts

Design Patents Subject to New Invalidity Test: The en banc Federal Circuit has just rejected the long-standing “Rosen-Durling” test as being too rigid to determine if a design patent is obvious.
