    Client Alert: Regulatory Enforcement of State Consumer Privacy Laws.   In recent years, a wave of consumer privacy laws has swept across many states. Unlike traditional legal areas where case law refines statutory provisions, most of these privacy statutes lack a private right of action, and are enforceable only by state Attorneys General or specialized enforcement agencies, such as California’s dedicated regulatory body.   Although public enforcement has been relatively restrained thus far, recent developments indicate a shift. Notably, California has led the way with significant settlements, including cases involving Sephora (2022), Google (2023), and DoorDash (early 2024). Even more recently, in September and October 2024, the Attorneys General from 16 states, including Texas and Indiana, launched or resumed actions against TikTok, focusing on protecting minors’ privacy on the platform.   • In our latest Client Alert, Quinn Emanuel Partner James Tecce and Of Counsel Bennett Murphy discuss two recent Delaware opinions interpreting the covenant of good faith and fair dealing in lender liability cases. In one of the decisions, the Court determined that applicable state law did not provide an independent cause of action for breach of the implied covenant. In another, the court held that lender actions expressly authorized under a loan agreement cannot be the basis for an implied covenant claim. James and Bennett also describe how the application of the covenant in lender liability cases has evolved in the forty years since the seminal 6th Circuit case of K.M.C. v.   • The staff and attorneys in our #Berlin office have this year chosen to support both the Berliner Kältehilfe charity, which provides overnight accommodation to the city’s homeless during the winter months.   For many years our #Hamburg office has donated to local children’s hospice Kinder-Hospiz Sternenbrücke, which provides end of life care for terminally ill children and young people, as well as support for their families. They are proud to do so again this year.   Supporting the Drogenverein Mannheim e.V. – a local charity that helps those struggling with substance abuse and their families - has for many years been the privilege of the staff and attorneys of our #Mannheim office during the Christmas season. This year was no different and they were able to fulfill the Christmas present wishes of over 60 children.   In #Munich, our staff and attorneys have donated over 150 vouchers for entrance to the zoo, Sealife, the movies, and various other activities to the children being cared for at the Münchner Waisenhaus (Munich Orphanage).   Our #Stuttgart office once again worked together with local charity “Frauen Helfen Helfen e.V.” to grant wishes to children and teenagers in children’s homes and other social facilities in Stuttgart.   Quinn Emanuel has a longstanding commitment to supporting meaningful causes around the world.     Quinn Emanuel Urquhart & Sullivan has promoted 11 attorneys to its partner ranks, the firm announced Monday. About half of the newly promoted partners are women, and most of the promoted partners have practices focused on international litigation or intellectual property. These new hires underscore Quinn Emanuel’s desire to expand its international scope. The firm promoted Alex Loomis to partner in Boston, and Manthi Wickramasooriya and Hafsa Zayyan in London. All three focus on international work, including appellate and commercial litigation. Of this new partner class, four attorneys are based in New York: Mario Gazzola, Nicola Felice, Nicholas LoCastro, and Anil Makhijani. Gazzola and Makhijani focus their practices on bankruptcy and financial or commercial litigation, while Felice works in patent litigation and intellectual property and LoCastro works on patent and contract disputes related to pharmaceutical clients. On the West Coast, Quinn Emanuel promoted one partner in Los Angeles and one in San Francisco. Based in LA, Mari Henderson is a crisis law and strategy partner and Jocelyn Ma, based in San Francisco, works on antitrust cases including commercial litigation and intellectual property disputes. The two new partners who will work out of Washington, D.C., are Sara Clark, whose practice focuses on government enforcement and white-collar criminal defense, and Kurt Wolfe, who specializes in enforcement actions by the U.S. Securities and Exchange Commission.
