🤔 Reflecting on Two Years of ChatGPT in Healthcare: It’s hard to believe it’s been two years since ChatGPT burst onto the scene, completely changing the landscape of healthcare. Here’s a recap of the trends and shifts we’ve seen since: ✅ AI-based digital health startups are receiving more and more funding, accounting for 40% of the total digital health funding in Q1 of this year. ✅ Healthcare providers are beginning to understand how AI can transform care delivery and improve patient outcomes. The AMA found that 66% of physicians see advantages to using AI, though only 38% were actively using it at the time. ✅ The regulatory landscape remains dynamic, with new policies implemented regularly. These policies are also frequently implemented at the state level, leading to fragmentation across the industry. ✅ Organizations are beginning to implement AI governance processes in order to ensure safety and compliance. While this has created new challenges for the companies building AI tools, it also marks an important step forward for the new and rapidly growing industry. Here at Nixon Law Group, we’ve been excited to see the transformative power of AI, and we’re thrilled to work with so many companies shaping the future of healthcare with these new technologies. $400 billion. That’s what the U.S. spends annually on just three diet-related conditions: diabetes, heart disease, and obesity. And these chronic illnesses are not just expensive to treat, they also contribute to more than 1.7 million preventable deaths each year. This is why Food as Medicine (FaM) is a game-changer for healthcare. Studies from the Women, Infants, and Children (WIC) program show that every $1 spent on food results in healthcare cost savings of $2.50. At Nixon Law Group, we’re proud to support the trailblazers making FaM a reality. Whether it’s navigating payor contracting or ensuring compliance with dietitian licensure, we’re here to offer full-service legal support for the change agents at the forefront of Food as Medicine. Let’s make 2025 the year we prioritize prevention, improve outcomes, and build a healthier future together. Contact us today to learn how we can work together: https://lnkd.in/eiyGUqF5

The annual ATA EDGE policy conference is one of my very favorite each year. Really smart people people sharing insights that, when taken together, paint a comprehensive picture of healthcare innovation in the U.S. It was a pleasure to share the stage with Julie Viola, MHA, Brendan O'Leary, and Ryan Williams, J.D., M.H.A. to talk about the evolution of #HealthAnywhere.
Day 2 of #ATAEDGE 2024 brought impactful discussions on the policies and innovations reshaping the healthcare landscape. From the evolving telehealth regulatory environment to the integration of artificial intelligence in virtual care, experts tackled the most pressing challenges and opportunities in modern healthcare. Highlights included insights into Medicare’s shifting policies, the American Medical Association's work to advance pediatric care through telehealth, and the critical role of state and federal policy in expanding access to equitable, patient-centered care. The day also featured thought-provoking conversations on AI’s potential to transform virtual care while addressing privacy concerns, the complexities of remote prescribing for controlled substances, and the ongoing challenges of licensing across state lines. Global perspectives on digital health innovation and a post-election analysis of policy implications with Dr. Larry Sabato rounded out the robust agenda. These discussions highlighted the critical role of ingenuity and thoughtful policy development in shaping the future of healthcare delivery. Just returned from a fantastic The AI Summit Series NYC, where I chaired a panel and moderated a fireside chat. ➡️ I joined Arvind Balasundaram, Ashish Sharma, Chaozheng Yang, and Robert Cardarelli for the panel "Innovating Healthcare with Synthetic Data: Balancing Risk, Reward, and Regulation." The panel delivered fascinating insights into the intersection of AI, healthcare, and analytics. The takeaway: synthetic data has the potential to bring healthcare products to market faster, but only if it is as robust as real-world data. Synthetic data is also compelling because it is less prone to privacy and regulatory risk. 📊 Vickram Kooblall and I held a fireside chat in the VisionAIres VIP lounge about "The Enterprise AI Legal Guide: Insights on Navigating Compliance and Regulatory Challenges." We discussed litigation, regulatory, and policy trends in the AI space related to consumer protection and the practice of law. 📚 My main takeaways from attending a variety of panels: 1. The "move fast and break things" approach to go-to-market and scaling healthcare AI solutions is challenging due to an ever-growing regulatory landscape. A "move strategically and avoid breaking things" approach may be better suited for solutions aimed at #patientcare. ➡️ 2. Without a centralized federal #regulatory framework for AI, startups should expect a web of distinct state AI laws (in addition to a growing contingent of state-level privacy laws). Think of good compliance as the start of good governance. ➡️ 3. Institutional sales cycles for healthcare AI solutions can be painstakingly long. The solution for sellers: level setting with buyers around the #data your model needs, security standards, and any explainability practices your organization implements. ➡️ 4. Commercial applications powered by generative AI are everywhere; now, it's a matter of product-market fit and differentiation (and in #healthcare, this means identifying the right reimbursement strategies). ➡️ 2025 will likely be the year of AI maturity as investment in the space continues and partnerships between startups and institutions expand (plus, the enthusiasm around the expo floor was impossible to ignore). 🚀 Jeff Englander Allan Gobbs Etienne Gillard Fabio Thiers, MD PhD Dr. D. ❓What does the DEA’s new regulation around controlled substances mean for telemedicine? We were glad to see that the Drug Enforcement Administration issued a third temporary extension of the COVID-19 flexibilities which allowed for prescribing controlled substances over telemedicine. Under these flexibilities, prescribers meeting certain criteria can issue Schedule II through V controlled substances without an in-person appointment. The extension will expire on Dec. 31, 2025, and in that time the DEA will work toward finalizing more permanent regulations for the future. If you’d like to better understand how this extension impacts your business, or you’re interested in advocating for permanent access to teleprescribing and want help submitting feedback, reach out to our team.

📈 With venture debt markets on the rise, healthcare startups may want to consider accessing non-dilutive funding to support their growth, expand into new markets, or fund R&D. With benefits like interest-only payments and the ability to bridge equity rounds, venture debt can offer flexibility without sacrificing equity. If you're interested in exploring venture debt, it's important to understand the legal implications.
