The Consumer Financial Protection Bureau (CFPB) has finalized its proposed rule that aims to close what CFPB Director Rohit Chopra has characterized as a “loophole” from certain consumer financial protection laws. The final rule requires large financial institutions to either cap their overdraft fees or otherwise treat courtesy overdraft services as covered credit and comply with requirements that commonly apply to traditional credit products. This week, Miller Nash was excited to deliver 100 Care Bags, $700 in gift cards for teens, and dozens of toys (including many, many Squishmallows!) to our wonderful friends at CASA for Children of Multnomah, Washington, Columbia, & Tillamook Counties. The dedicated team at CASA will ensure these items reach the many deserving children they support daily. CASA’s mission to improve outcomes for children in foster care is driven by their network of volunteers who advocate for the best interests of children who have experienced abuse and neglect. These donations are part of two initiatives: the Care Bags were lovingly assembled by Miller Nash partners from all of our offices, and they continue to contribute to this cause as part of a matching fundraising drive this week. The gift cards and toys were generously donated by our Portland office employees over the last three weeks. Oregon is on the verge of implementing the first extended producer responsibility (EPR) law in the United States broadly targeting recyclable materials with the goal of increasing recycling rates and reducing waste in July 2025. EPR laws are common in other countries; however, Oregon would be the first to implement EPR laws in the United States. In a recent article, Miller Nash attorneys Will Rasmussen and Blakely Vogel discuss the history of EPR laws, the environmental and financial benefits, and the precedent this law would set for other states if successful.
