This December 22, we honor the anniversary of the Don't Ask, Don't Tell (DADT) Repeal Act of 2010–a pivotal step toward equality in the U.S. military. Lambda Legal's fight against the discrimination of LGBTQ+ people in the armed forces began long before DADT—winning our first case against anti-gay discrimination by the military in 1975. Since then, we’ve fought tirelessly for LGBTQ+ service members who wish to serve their country with dignity and respect. Today, we celebrate this landmark victory and salute all who made this historic moment a reality. Congress ignored science. They chose discrimination. 💔 Yesterday, Congress passed the National Defense Authorization Act (NDAA), including a harmful provision that denies military families access to gender-affirming care for their kids. This provision specifically blocks trans youth from accessing this care while allowing the coverage of the exact same forms of care for children who are not transgender. Today, the U.S. Senate passed a new defense spending bill that bans TRICARE, the military’s health care program, from covering best practice medical care for transgender children of service members. “Make no mistake: gender-affirming medical care for children is safe, effective, and essential, and endorsed by all major U.S. medical association,” said Kristine Kippins, our Deputy Legal Director for Policy. “But, instead of following the science, members of the House and Senate have approved a discriminatory ban on care that is readily provided for children who are not transgender. BREAKING NEWS: The Montana Supreme Court has ruled in favor of families and doctors, blocking a ban on health care for transgender youth! 🎉 Today’s ruling blocks SB 99, a 2023 Montana law that seeks to categorically ban life-saving gender-affirming care for transgender youth, while litigation on the law continues.
