The result is that there is a growing number of communities across America that no longer have ready access to the trusted and affordable healthcare provided by community pharmacies. An article published by STAT this week discusses the latest progress in Congress to address some of the more egregious business practices of the large, legacy PBM companies. According to the STAT article, as part of a year-end government funding package, there was agreement to fund public health programs, extend telehealth flexibilities, and implement long sought PBM reform measures. The article states: “The policies in the package would put guardrails around how PBMs can operate. Measures expected to be included would prohibit PBMs from linking their payments to drug prices in Medicare, increase transparency, and regulate how PBMs get paid for drugs by Medicaid programs.” At EmpiRx Health, we strongly support PBM reform legislation and urge Congress to take swift action. EmpiRx Health CEO Danny S. is quoted in Fierce Healthcare’s newly published article, "2025 Outlook: Alternative PBMs Look to Heap Pressure on Industry Titans." The article discusses how PBMs are facing increasing scrutiny in 2024, with reform efforts steadily gaining momentum in Congress. While the largest three PBMs have mostly avoided major changes, alternative PBMs (like EmpiRx Health) are making strides. Danny notes: “If you investigate what PBMs and rebate aggregators are doing, they’re just shifting to fees. By the time some of this stuff is actually brought forward and executed on, PBMs would have already evolved to another way of monetizing those dollars.” As legislative pressure continues to grow, legacy PBMs’ business practices may be reshaped by legal action and shifting market trends, according to the Fierce Healthcare article. EmpiRx Health strongly supports the recent PBM legislation that was just announced by Senators Elizabeth Warren and Josh Hawley, together with Representatives Diana Harshbarger and Jake Auchincloss. Called the Patients Before Monopolies (PBM) Act, the bipartisan legislation proposes that parent companies of PBMs and insurers will be prohibited from owning a pharmacy business. It would require the divestiture of pharmacy assets within three years. At EmpiRx Health, we think it’s about time! We hope this will help bring an end to the anti-competitive practices of the big three PBMs, which prioritize profits over patient health. This software enables EmpiRx Health’s pharmacists to conduct clinical reviews, driving clinically-appropriate drug therapy decisions that optimize patient health outcomes and substantially reduce drug costs. In one instance, our Clinical Pharmacist used this Clinical Review capability and discovered that a patient’s prescribed medication could worsen their existing symptoms of inflammatory bowel disease. A more clinically-appropriate, lower-cost medication was recommended, resulting in improved health outcomes for the member and an annual savings of $21,068 for the plan sponsor.
