I was recently asked to comment on the FTC's new regulation seeking to invalidate non-compete agreements. I have litigated these cases for years, and believe that they can be necessary, but have seen that too often they are used to invalidly restrain competition and employees usually don't have the resources to fight against the invalid agreements. While I would have hoped that state legislators could have created greater penalties for forcing invalid agreements on workers to permit them to be challenged, at this point, I don't see any other way to limit the harm on competition caused by agreements that restrict sandwich makers, daycare workers and hair stylists along with those with access to secrets or employer-created relationships who truly who should be restricted from unfairly competing. https://lnkd.in/eE2sp8Jq

On March 7th, please join Delegal, Poindexter, and Underkofler, P.A., the Literacy Alliance of Northeast Florida, and San Marco Books for a showing of Theater Jacksonville’s production of Alabama Story. The play, inspired by true events, tells of the uproar in 1959 Montgomery, Alabama over a children’s book sought to be banned by a segregationist Senator. The show begins at 7:30 p.m. Tickets for the show can be purchased at Alabama Story Donations – Literacy Alliance of NEFL (literacyallnefl.org). San Marco Books is hosting a pre-show shopping event with local authors Mark Woods, Tim Gilmore, Jessica Q. Stark, Michael Wiley, Devin Coleman, and Sohrab Fracis. Join us at San Marco Books beginning at 5:30 p.m. for wine, cheese, and a celebration of books before heading over to Theater Jacksonville for the 7:30 p.m. showtime. Delegal, Poindexter, and Underkofler, P.A. is the show’s sponsor and will donate all proceeds from the show to the Literacy Alliance of Northeast Florida, a 501(c)(3) providing literacy education to students between the ages of 16 and 80 at no cost to students.
