Business owners, take note! A Supreme Court decision last month ruled that one of the most common strategies for continuity and succession planning with closely-held, multi-owner corporations didn’t provide the expected benefits. In this particular case, Connelly v. US resulted in the owner’s estate actually owing close to $900,000 more in estate tax. This can cripple – and quite literally, put out of business – almost any company, but especially family businesses that regularly use life insurance to repurchase an owner’s stock upon their death. Now, I’m not a corporate attorney or tax advisor, and I don’t sell life insurance. I do serve countless business owners though who need to seek counsel on this crucial decision before it’s too late.
