Happy Halloween!!! 👻 🎃 Topic of the Week: Scary Technology including FINRA’s request for feedback on #metaverse technology. Or the Federal Trade Commission’s new “Operation AI Comply” that resulted in 5 fines for companies falsely touting the usage of AI. And speaking of scary: living wills for clearing agencies oh my! But scary can also be good, like roller coasters, #artificialintelligence, and now our own #chatbot Your heard me right! RegAlytics is in beta with our RegPass chatbot! I am learning so much from it and about it. Thank you James Nicholls at Braithwate! What an incredible partner! The Depository Trust & Clearing Corporation (DTCC) OCC

⚠ The Clock is Ticking: Get Your Consumer Duty Board Report Ready by 31 July 2024 🚨 The deadline for Consumer Duty Board Reports is 31 July 2024. This is a critical part of your compliance framework, ensuring you're delivering good outcomes for retail customers as mandated by the FCA’s Consumer Duty. 📈 Producing this annual report can be complex and requires meticulous documentation. Your report must confirm compliance with Consumer Duty obligations and be backed by solid evidence. The FCA expects firms to implement continuous monitoring and robust governance — not just a once-a-year check box exercise. 🛠️ Every aspect of your consumer operations must align with Consumer Duty principles. Detailed reporting on monitoring activities, risk assessments, customer outcomes, and remedial actions is essential. The FCA may scrutinize your underlying data, so accuracy is key. ⏰ Start now! Clearly define roles, prioritise data collection, and develop a comprehensive plan. Regular updates and checkpoints are crucial. Engage your Board and stakeholders early to avoid a last-minute scramble. 👇 Braithwate has produced a detailed FAQ on how to produce the Consumer Duty Board Report. Link below in the first comment.

⚠ “We Can't Afford This Risk Management Project” ⚠ 🔥 💵 The FCA has now issued over £4.1 billion in fines since 2014. Today’s £62 million fine imposed on Citi by the Bank of England (PRA) and the Financial Conduct Authority highlights the severe consequences of inadequate risk management systems. Citi's breaches of multiple PRA and FCA rules between April 2018 and May 2022 underscore the substantial financial and reputational risks associated with non-compliance. Similar costly penalties have been levied on other major banks, such as the £1.1 billion fines for G10 spot FX trading violations. As these cases illustrate, the financial and operational impacts of poor risk management extend far beyond the initial fines, encompassing remediation costs, reputational damage, client trust erosion, and increased regulatory scrutiny. While it can be tempting to implement a "minimal compliant solution" and firms understandably wish to "avoid gold-plating", controls must be effective. At Braithwate, we have a track record of helping our clients design and implement pragmatic and proportionate controls - and helping them scale as the business grows. This can be especially relevant in fast-growing fintechs, where cash is often very tight in the early days, but rapid growth can leave controls in the dust. >> See link in comments for our full write up. #WeCantAffordThisRiskManagementProject #Fines #ControlFailure
