On January 3, 2025, the IRS and the Treasury released long-awaited final regulations regarding the clean hydrogen production tax credit under section 45V of the Internal Revenue Code. The credit, enacted by the Inflation Reduction Act of 2022 , is a key component of the Biden Administration’s clean energy initiative and is the primary tax incentive for the production of clean hydrogen. Last month, Baker Botts partner Mark Speegle delivered a presentation on Intellectual Property in the context of government contracting and start-ups for the Army Applications Laboratory (AAL). Headquartered at the Capital Factory in Austin, AAL serves as the innovation arm of Army Futures Command, connecting nontraditional industries with the Army to accelerate the delivery of cutting-edge technology to Soldiers. Mark’s presentation was part of our Emerging Companies/Venture Capital (ECVC) initiative, through which we’re collaborating with innovators to drive advancements in technology across diverse markets.

On January 2, 2025, the US Department of the Treasury's regulations implementing Executive Order 14105 “Addressing United States Investments in Certain National Security Technologies and Products in Countries of Concern” became effective. Depending on the nature of the transaction, the Outbound Investment Regulations could (1) require a US person (defined to include US citizens, lawful permanent residents, entities organized under the laws of the United States or any US jurisdiction, and any foreign branch of such entities) to notify an outbound investment transaction to the US Department of the Treasury, or (2) prohibit US persons from engaging in such outbound investment transactions. Our BB Vets Affinity Group was proud to sponsor volunteer teams from each of our U.S. offices to take part in Wreaths Across America on December 14, 2024. This meaningful event brought our lawyers and staff together, even from separate locations across the country, as they laid wreaths at seven veterans cemeteries near our U.S. offices. Wreaths Across America organizes wreath-laying ceremonies at Arlington National Cemetery and over 4,800 other locations nationwide, at sea, and abroad.
