📢 Relevant developments in Korean private cartel damage claims! 🌐 Cecil Chung, Co-Chair of our Committee, and coauthors have provided a timely update on a recent court decision in the TFT-LCD collusion damages case. In their article, the authors summarize a decision by the Seoul Central District Court from November 23, 2023, which ordered two Taiwan-based TFT-LCD suppliers to pay KRW 32.9 billion (approx. USD 25.5 million) in damages to LG Electronics and its six affiliates based outside Korea. The Korean civil private damages case revolved around four key issues: 🔹 Jurisdiction 🔹 Governing law 🔹 Plaintiffs’ own participation in the cartel 🔹 Damages calculation This recent court decision is noteworthy because Korean cartel enforcement has mostly been public (i.e., KFTC enforcement actions) rather than private in nature.
