The key issue here is that conflict during a commercial lease is a symptom of an initial lease negotiation where the Lessee did not consider, or did not have the experience to consider, all of the points of potential conflict, and therefore could not negotiate appropriate contingencies into the lease from inception. A properly structured lease which has been negotiated by an experienced CRE Advisor, should be self governing, with appropriate incentivisation built in for both Lessee and Lessor to meet their obligations under the Lease.
